Please read these terms carefully before using Bask.

These Terms of Service ("Terms") govern your access to and use of the Bask mobile application and related services (collectively, the "Services") provided by Ferrix Labs Inc. ("we," "us," or "our"), a company incorporated in Nova Scotia, Canada. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

By creating an account, downloading, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

1. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use our Services. By creating an account, you represent and warrant that you meet this age requirement and are legally capable of entering into a binding agreement. Our Services are available worldwide, subject to applicable local laws and regulations.

2. Description of Services

Bask is an AI-powered tanning guidance application that provides:

  • Personalized daily tanning recommendations based on your skin type, location, and real-time weather and UV conditions
  • Tanning session timer with SPF recommendations and flip reminders
  • Progress photo tracking to visualize your tan over time
  • Push notifications for optimal tanning windows and session alerts
  • AI-generated tanning guidance and wellness tips

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.

3. Health and Safety Disclaimer

IMPORTANT: PLEASE READ CAREFULLY

Bask is not a medical device and is not approved or regulated by the FDA, Health Canada, or any other health regulatory authority. The Services do not provide medical advice, diagnosis, or treatment.

UV exposure carries inherent health risks, including but not limited to:

  • Skin cancer (including melanoma, basal cell carcinoma, and squamous cell carcinoma)
  • Premature skin aging (wrinkles, dark spots)
  • Sunburn (including severe burns requiring medical care)
  • Eye damage (cataracts, macular degeneration)
  • Immune system suppression
  • Photosensitivity reactions from medications or skin conditions

You should always consult with a qualified healthcare provider or dermatologist before beginning any tanning routine, especially if you:

  • Have a personal or family history of skin cancer
  • Have fair skin that burns easily (Fitzpatrick Skin Type I)
  • Take photosensitive medications (antibiotics, retinoids, NSAIDs, diuretics, certain antidepressants, etc.)
  • Have numerous moles, freckles, or atypical skin lesions
  • Have a history of severe sunburns
  • Have any skin condition (eczema, psoriasis, lupus, etc.)

BY USING THE SERVICES, YOU ACKNOWLEDGE AND AGREE THAT YOU ASSUME ALL RISK ASSOCIATED WITH UV EXPOSURE AND SUN TANNING. THE RECOMMENDATIONS PROVIDED BY BASK ARE GENERAL GUIDANCE ONLY AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

4. AI-Generated Content Disclaimer

Limitations of AI Recommendations

Bask's tanning recommendations are generated by artificial intelligence based on general models and available data. They are not personalized medical assessments. You should be aware that:

  • UV and weather data is sourced from third-party providers (OpenWeatherMap) and may contain inaccuracies, delays, or gaps in coverage
  • AI models produce recommendations based on generalized assumptions that may not account for your unique physiology, medical conditions, or environmental factors
  • Individual skin sensitivity varies significantly, even within the same Fitzpatrick skin type classification
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated content
  • You are solely responsible for verifying that any recommendation is appropriate for your circumstances

5. User Accounts

  • You must provide accurate and complete information when creating your account
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account
  • You may maintain only one account
  • You must notify us immediately at bask@ferrixlabs.com if you suspect unauthorized access to your account
  • We reserve the right to suspend or terminate your account for violations of these Terms, fraudulent activity, or abuse of the Services

6. User Content

You may submit content to the Services, including profile information, skin profile data, and progress photos ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the Services. This license is limited to:

  • Operating and maintaining the Services (displaying your photos to you, generating recommendations)
  • Technical operations (storage, backup, encryption)

We will never sell, sublicense, or publicly distribute your User Content. You retain full ownership of all User Content you submit. You can delete your User Content at any time through the app.

7. Subscription and Payments

  • Premium features of Bask require a paid subscription
  • All payments are processed through Apple In-App Purchase. Subscription prices are displayed in the app and may vary by region
  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date
  • You can manage or cancel your subscription through your Apple ID account settings, through the app, or by contacting us at bask@ferrixlabs.com
  • Refunds are subject to Apple's refund policies. Subscriptions are generally non-refundable except where required by applicable law

8. Intellectual Property

All content, features, and functionality of the Services (including but not limited to text, graphics, logos, icons, software, AI models, and user interface design) are owned by Ferrix Labs Inc. and are protected by Canadian, United States, and international intellectual property laws, including copyright, trademark, patent, and trade secret laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or otherwise use any of our intellectual property without our prior written consent.

9. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy. Your data may be transferred to and processed in Canada, the United States, or other countries as described in our Privacy Policy.

10. Disclaimers of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FERRIX LABS INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we make no warranty or representation that:

  • The Services will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Services will be accurate, reliable, or suitable for any purpose
  • UV, weather, or tanning recommendations will be accurate or appropriate for your individual circumstances
  • The Services will meet your specific health, safety, or aesthetic expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FERRIX LABS INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Personal injury, sunburn, skin damage, or any health consequence resulting from UV exposure, whether or not based on recommendations provided by the Services
  • Loss of profits, data, or business opportunities
  • Costs of substitute goods or services
  • Any damages arising from inaccurate UV, weather, or tanning recommendations

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

12. Indemnification

You agree to indemnify, defend, and hold harmless Ferrix Labs Inc. and its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the Services
  • Any health-related claims arising from your UV exposure or tanning activities
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any User Content you submit that infringes a third party's rights
  • Your negligence or willful misconduct

13. Dispute Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms or the Services:

  • Informal Resolution: You and Ferrix Labs Inc. agree to first attempt to resolve the dispute informally by contacting us at bask@ferrixlabs.com. We will attempt to resolve the dispute within 30 days of receiving your notice.
  • Binding Arbitration: If the dispute cannot be resolved informally, it shall be resolved through binding arbitration conducted in Nova Scotia, Canada, in accordance with the rules of the ADR Institute of Canada. The arbitration shall be conducted in English by a single arbitrator. The arbitrator's decision shall be final and binding.
  • Class Action Waiver (US Users): To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

Consumer Protection Preserved

Nothing in these Terms limits your rights under mandatory consumer protection laws in your jurisdiction. If you are a resident of a jurisdiction where mandatory arbitration or class action waivers are prohibited, those provisions shall not apply to you.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Nova Scotia, Canada, for the resolution of any disputes not subject to arbitration, subject to any applicable consumer protection laws in your jurisdiction that may require disputes to be resolved in your local courts.

15. Termination

  • By You: You may terminate your account at any time by deleting your account through the app's settings or by contacting us at bask@ferrixlabs.com
  • By Us: We may terminate or suspend your account immediately, with or without notice, for any reason, including but not limited to: violation of these Terms, fraudulent activity, or abuse of the Services
  • Effect of Termination: Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination will survive, including: Health and Safety Disclaimer, Disclaimers of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and Intellectual Property

16. Miscellaneous

  • Force Majeure: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, pandemics, government actions, internet or infrastructure failures, or third-party service outages
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction
  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ferrix Labs Inc. regarding the Services
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect
  • No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision
  • Headings: Section headings are for convenience only and do not affect the interpretation of these Terms
